Multi-generational family estate — Faraid and civil law intersection
The Situation
A family in Kuching with assets held in both personal and business names, a mix of Muslim and non-Muslim beneficiaries, and no existing will. The family sought guidance on how to distribute the estate fairly and in compliance with applicable law.
Our Approach
A thorough initial consultation to map the asset landscape, followed by separate meetings with relevant family members. A detailed framework for the estate was prepared, addressing Faraid entitlements alongside civil succession, with a recommended structure for the business assets.
The Outcome
A clear estate plan accepted by all family members, including a valid will, updated business documentation, and a long-term stewardship engagement for the family's ongoing advisory needs. Timeline: approximately four months from initial session to completion.
Contested probate — executor challenged by two beneficiaries
The Situation
An executor named in a will faced a challenge from two beneficiaries who disputed the validity of certain estate transactions. Relations within the family had deteriorated significantly by the time we were engaged.
Our Approach
A review of all documentation was conducted before any communication with the opposing parties. Correspondence was kept measured and factual. A structured mediation process was proposed and accepted, avoiding the need for full court proceedings.
The Outcome
The dispute was resolved through mediation. The executor's position was upheld with modifications acceptable to all parties. Family relationships, while strained, were not further damaged by the process. Timeline: approximately six months from engagement.
Estate administration — probate for an uncomplicated estate
The Situation
A widow in her 60s needed assistance with the probate process following her husband's passing. A valid will existed, and the estate was relatively straightforward, but the administrative process was unfamiliar and she wished not to manage it alone.
Our Approach
We prepared all court application documents, communicated with the relevant institutions on the client's behalf, and kept her informed at each stage in plain terms. She attended only one court appointment.
The Outcome
Probate was obtained and the estate administered without difficulty. The client described the experience as considerably less stressful than expected. Timeline: approximately three months from initial consultation to estate distribution.
