1. Definitions

For the purposes of this Agreement, the following terms shall have the meanings indicated:

"Service" / "Services"

The estate and inheritance legal services offered by Bintang Legal, including but not limited to the Estate and Inheritance Initial Consultation, Contested Estate and Dispute Counsel, and Family Estate Stewardship Counsel engagements.

"We" / "Us" / "Our" / "Bintang Legal"

Bintang Legal, a legal practice operating from Level 10, Wisma Saberkas, Jalan Tun Abang Haji Openg, 93000 Kuching, Sarawak, Malaysia.

"You" / "Client" / "User"

Any individual or legal entity that engages Bintang Legal for legal services, submits an enquiry through this website, or accesses content provided herein.

"Content"

All text, materials, documents, legal work product, and other information provided by Bintang Legal through this website or in the course of an engagement.

"Engagement"

A formal instruction from a client to Bintang Legal to provide legal services, confirmed in writing through an engagement letter or fee agreement.

2. Acceptance of Terms

By accessing this website or engaging Bintang Legal's services in any manner, you acknowledge that:

• You have read, understood, and agree to be bound by these Terms and Conditions;
• You are of legal age — at least 18 years of age or the age of majority in your jurisdiction, whichever is greater;
• You have the legal capacity to enter into this Agreement, whether on your own behalf or as an authorised representative of a legal entity;
• These terms, together with any engagement letter issued, constitute the full agreement between you and Bintang Legal.

If you do not agree to these terms, please do not engage our services or use this website.

3. Service Description

Bintang Legal provides estate and inheritance legal services in Sarawak, Malaysia. Our principal service offerings are:

Service availability is subject to Bintang Legal's professional capacity and applicable Malaysian legal and professional standards. We reserve the right to decline any instruction that may conflict with our professional obligations or applicable regulations.

4. Client Responsibilities

Clients engaging Bintang Legal agree to:

• Provide accurate, complete, and timely information as requested to allow us to advise effectively;
• Inform us promptly of any changes in circumstances that may be relevant to the engagement;
• Comply with all reasonable requests for documentation or verification required under Malaysian law;
• Not instruct Bintang Legal in any matter that could constitute a breach of Malaysian law or professional regulations;
• Treat our staff with courtesy and professionalism throughout the engagement;
• Not reproduce, distribute, or commercially exploit any legal work product produced by Bintang Legal beyond the scope of the engagement.

5. Intellectual Property

All content on this website — including text, design, layout, and descriptive material — is the intellectual property of Bintang Legal and is protected under Malaysian copyright law and applicable intellectual property provisions.

You are granted a limited, non-exclusive, non-transferable licence to access and view website content for personal, non-commercial purposes. This licence does not permit you to:

• Reproduce or republish website content without prior written permission;
• Use website content for commercial purposes or advertising;
• Modify, adapt, or create derivative works from our materials;
• Remove or obscure any copyright or proprietary notices.

Legal work product prepared specifically for a client's engagement remains the client's property upon settlement of all applicable fees, subject to Bintang Legal's right to retain a copy for professional records.

6. Fees & Payment

All fees are quoted in Malaysian Ringgit (RM) and are subject to any applicable taxes or levies in force at the time of service.

6.1 Engagement Fees

The fees set out in Section 3 above represent the base engagement fees. Additional work outside the agreed scope may be subject to separate fee arrangements, which will be communicated to you in writing before being undertaken.

6.2 Payment Terms

Payment terms will be set out in your engagement letter. Unless otherwise agreed, fees are payable in advance of or at the time of service. Accepted payment methods will be confirmed at the time of engagement.

6.3 Cancellations and Adjustments

Where a client cancels a scheduled session with at least 48 hours' notice, fees paid in advance may be applied to a rescheduled appointment. Fees for work already completed are not refundable. We handle all such matters with consideration for the client's circumstances.

7. Engagement Terms

Each engagement with Bintang Legal is governed by the terms set out in this Agreement and supplemented by any engagement letter issued for that specific matter. The following applies across all engagements:

• Scope: Work will be limited to the scope agreed at the outset. Changes to scope require written agreement from both parties.
• Timelines: Estimated timelines are provided in good faith and may be affected by court schedules, third-party responses, or the complexity of the matter. We will keep you informed of material changes.
• Documentation: Clients are responsible for retaining original documents. Bintang Legal will maintain copies as required by professional obligations.
• Communication: We will communicate primarily in English or Bahasa Malaysia. Our preference is for written confirmation of important instructions.

8. Confidentiality

Bintang Legal treats all client information with strict professional confidence, in accordance with our obligations under the Legal Profession Act 1976 and applicable professional standards. We will not disclose confidential information to third parties except:

• Where required to do so by law or court order;
• With your prior written consent;
• Where disclosure is necessary to prevent a serious criminal offence or harm.

The confidentiality obligation extends to all members of our team and survives the conclusion of any engagement.

9. Disclaimers

10. Limitation of Liability

To the extent permitted by Malaysian law, Bintang Legal's aggregate liability arising from or in connection with any engagement shall not exceed the total fees paid by the client for that specific engagement.

Bintang Legal shall not be liable for:

• Indirect or consequential loss arising from reliance on information provided;
• Loss attributable to inaccurate or incomplete information provided by the client;
• Delays caused by third parties, courts, government bodies, or circumstances outside our reasonable control;
• Force majeure events including natural disasters, civil disruption, or regulatory change.

Nothing in this Agreement limits liability for fraud, gross negligence, or liability that cannot be limited under applicable Malaysian law.

11. Indemnification

You agree to indemnify and hold harmless Bintang Legal, its partners, and staff from and against any claims, losses, or costs (including reasonable legal costs) arising from your breach of this Agreement, your provision of inaccurate or misleading information, or any unlawful conduct on your part in connection with the engagement.

12. Termination

12.1 Termination by Client

You may conclude an engagement at any time by written notice to Bintang Legal. Fees for work completed to the date of termination remain payable.

12.2 Termination by Bintang Legal

Bintang Legal reserves the right to withdraw from an engagement where: a client breaches these terms, where continued representation would create a conflict of interest, where instructions are inconsistent with our professional obligations, or where fees remain unpaid following reasonable notice.

12.3 Effect of Termination

Upon termination, Bintang Legal will take reasonable steps to avoid prejudice to the client's interests and to facilitate the orderly handover of the matter. Provisions relating to fees, confidentiality, intellectual property, and dispute resolution shall survive termination of this Agreement.

13. Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Malaysia, with Kuching, Sarawak as the preferred venue where applicable.

Before commencing formal proceedings, either party may request an informal resolution meeting. Both parties agree to engage in this process in good faith for a period of not less than 21 days before resorting to litigation or arbitration.

Where a dispute arises from a legal engagement, clients may also seek recourse through the Malaysian Bar Council's complaint mechanism, independent of any steps taken under this Agreement.

Bintang Legal may update these Terms and Conditions from time to time to reflect changes in our practice, applicable law, or professional requirements. The date of the most recent revision will be noted at the top of this page.

For existing clients with active engagements, material changes will be communicated directly before taking effect. For website visitors, continued use of this website following publication of updated terms will constitute acceptance of those terms. We encourage you to review this page periodically.
