Do I need a will if I already have a Faraid distribution plan?
Faraid governs the distribution of a Muslim estate under Islamic law, but a formally executed will can still serve important functions — particularly for assets that fall outside Faraid scope, for specific bequests within the allowable third, and for nominating an executor who understands the family's wishes. We can help clarify what each framework covers in your specific situation.
What is the difference between probate and letters of administration?
Probate applies when the deceased left a valid will, and grants the named executor authority to administer the estate. Letters of administration are sought when there is no will — the court appoints an administrator, often a family member, to manage and distribute the estate according to the applicable law. Both processes require court application in Malaysia, and we can guide families through either pathway.
How long does an estate administration typically take in Sarawak?
Timelines vary considerably depending on the complexity of the estate, whether disputes arise, and court scheduling. Straightforward matters can resolve in several months; contested or complex estates may take considerably longer. We will give you a candid assessment of what to expect once we have reviewed the specific circumstances.
My family is disputing a parent's will. What are the first steps?
The first step is to gather all available documentation — the will, any earlier versions, relevant property records, and correspondence. From there, an initial consultation helps clarify the legal basis for any challenge and what avenues exist, whether that is mediation, formal objection during probate, or other proceedings. Acting promptly can be important, as some processes have time limitations.
Can EPF and insurance proceeds be directed outside a will?
Yes. EPF savings and life insurance policies pass to named nominees directly and do not form part of the estate for distribution purposes in the conventional sense. Keeping these nominations current and aligned with the family's broader estate plan is an important step that many families overlook. We address this as part of our initial consultation.
